TO THE EXTENT SUCH DISCLAIMER CONFLICTS WITH APPLICABLE LAW, THE SCOPE AND DURATION OF ANY APPLICABLE WARRANTY WILL BE THE MINIMUM PERMITTED UNDER SUCH LAW.

Indemnification

You agree to indemnify, defend, and hold harmless Glow'rious Routine Inc., its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Errors

In the event that a product is mistakenly listed at an incorrect price on the Site, Glow'rious Routine reserves the right to refuse or cancel any orders placed for products listed at the incorrect price whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Glow'rious Routine shall issue a refund to your credit card account in the amount of the incorrect price.

Termination

These Agreements, or any part of the Term of Use, may be terminated by Glow'rious Routine Inc. without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Glow'rious Routine Inc. may deliver notice to you by means of e-mail or by another reliable method through your contact information provided to Glow'rious Routine Inc. If you have subscribed to our electronic newsletter, you may unsubscribe at any time.

Exclusion of Damages; Limitation of Liability

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT OR OTHERWISE, WILL GLOW’RIOUS ROUTINE, INC. BE LIABLE TO THE USER FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY CHARACTER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOST SALES OR BUSINESS, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, LOST DATA, OR FOR ANY AND ALL OTHER DAMAGES OR LOSSES, EVEN IF GLOW'RIOUS ROUTINE INC. HAS BEEN ADVISED, KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.

UNDER NO CIRCUMSTANCES AND NO LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WILL GLOW'RIOUS ROUTINE INC. BE LIABLE TO THE USER FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SERVICES, MATERIALS OR PRODUCTS ON THIS SITE OR THE PERFORMANCE OF THE MATERIAL OR PRODUCTS, EVEN IF GLOW’RIOUS ROUTINE, INC. HAS BEEN ADVISED, KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.

THE PROVISIONS OF THIS SECTION ALLOCATE THE RISKS UNDER THIS AGREEMENT BETWEEN THE PARTIES, AND THE PARTIES HAVE RELIED ON THE LIMITATIONS SET FORTH HEREIN IN DETERMINING WHETHER TO ENTER INTO THIS AGREEMENT.

Terms

The term of this Agreement will commence on the date the User has accessed the Site.

Governing Law

The laws of Canada govern these Terms of Use. You hereby consent to the exclusive jurisdiction of the Canadian courts in all disputes arising out of or relating to this Agreement. Glow'rious Routine may, and you may not assign, convey, subcontract or delegate rights, duties or obligations hereunder.
